Over the years we have acquired extensive experience in managing legal issues related to relationships between consumers and banks, financial and consumer credit companies, telecommunications companies (landline, mobile and internet services), transportation companies (air, marine and railway), companies providing utilities (gas and electricity), insurance companies, as well as between consumers and tourist operators.
The specialized legal services we offer in this sector include the protection of individual consumers (and micro-enterprises pursuant to Arts. 18 and 19 of the Consumer Code), pursuant to the Consumer Code (Leg. Decree 206 of 6 September 2005), the Private Insurance Code (Leg. Decree 209/2005), the Electronic Communications Code (Arts. 70 et seq. of Leg. Decree 259 of 1 August 2003), and the Tourist Code (Leg. Decree 79 of 23 May 2001), and assistance to businesses and professionals – in accordance with the same above legislation– aimed at ensuring compliance of the activities and consumer relations (even remotely, or based on online platforms) with the relative legislative framework (including the regulatory framework resulting from independent Administrative Authorities in the sector, like resolutions enacted by AGCM or AGCOM).
The assistance also includes management and representation before the regulatory Authorities, both for investigations and sanction proceedings and for preventive procedures (e.g., Art. 37-bis of the Consumer Code for applications to AGCM which provides for a preliminary examination of the vexatious nature of clauses included in contracts or consumer forms, reports to AGCOM for unfair practices in the electronic communications sector, etc.).
