The American Data Privacy & Protection Act: practical commentary on the proposed U.S. federal data protection rules - Part IV.

Prof. Avv. Alessandro del Ninno publishes a practical commentary - in the form of questions and answers - on the American Data Privacy and Protection Act - ADPPA (the proposal for a federal US data protection law) with the aim of identifying and clarifying - also in a comparative perspective with the European GDPR - the practical and application profiles of greatest interest to those who will be called to comply with future federal data protection legislation.

In this fourth contribution some comparative considerations are carried out about the definitions of the ADPPA and the GDPR, we begin to illustrate the fundamental principles of data processing envisaged by the federal law proposal, examining in particular how the principles of necessity are declined in the ADPPA, minimization and proportionality, to conclude with the analysis of how "sensitive data" is regulated (and what they are) for the (future) US data protection law.
