GDPR and the AI Act: a comparative analysis in the light of employers' obligations and employees' rights.

Prof. Avv. Alessandro del Ninno illustrates from an operational perspective the organisational and technical requirements that employers employing algorithmic technologies and conducting automated data processing must implement to protect workers' fundamental rights and freedoms, in light of the GDPR's obligations on transparency of information, risk analysis and assessment, conducting Impact Assessments, automated processing and profiling (with reference also to the relationship between the GDPR and the current version of the Transparency Decree on automated monitoring and decision-making systems).

In addition, specific practical remarks are made in view of the future entry into force of the EU General Regulation on Artificial Intelligence, with the new employer obligations in the case of the use of 'high-risk' AI systems in the management of the employment relationship.
