Law no. 102/2023 amending the Italian Industrial Property Code published in the Official Gazette.
Law No. 102 revising the Industrial Property Code was published in Official Gazette No. 184, Aug. 8, 2023.
Many changes and improvements have been introduced. Two new rules stand out in particular: the introduction of the possibility of coexistence of an Italian patent and a European patent designating Italy (or with unitary effects) on the same invention as well as the return to before 2001, with Articles 65 and 65-bis C.P.I. restoring the right of universities and other public research bodies to patent inventions made by their researchers in execution of the employment relationship.
