China enacts the first legislative measures to regulate the generative AI.
China leads the way and becomes one of the first countries in the world to have specific regulatory measures for the regulation of generative Artificial Intelligence.
Indeed, on August 15, 2023, regulations of the "Interim Measures for the Management of Generative Artificial Intelligence Services" drafted by the Cyberspace Administration of China (CAC) and six other relevant national agencies came into effect.
The Measures prescribe a number of responsibilities for generative AI service providers, including but not limited to: AI governance, training data requirements, dataset labeling and marking standards, data protection protocols, and safeguarding user rights.
The Measures apply to the use of generative AI technology to provide text, image, audio, video and other content generation services to the public in China. Industrial organizations, enterprises, educational and scientific research institutions, public cultural institutions, and professional institutions that develop and apply generative AI technology but do not provide generative AI services to the Chinese public are exempt. Technologies intended for users outside China are also exempt.
"Generative AI technologies" are defined as "models and related technologies capable of generating content in the form of text, images, audio and video." "Generative AI Services" is defined as "a service offered to the public that generates content in the form of text, images, audio and video through the use of generative AI technologies."
"Generative AI Service Provider" means "an entity or individual that uses generative AI technologies to provide Generative AI Services, including the provision of generative AI services via application programming interface (API) or other methods."
