Court of Cassation: the doctor who records an interview with a colleague to constitute trial ev-idence cannot be sanctioned.
The recording of an interview between colleagues, in which the recording person participates, aimed at acquiring evidence to be used in court, is not detrimental to the right to confidentiality, even if it is carried out without the consent of the interested party, because it is necessary for the purpose of carrying out defensive investigations or in any case to assert or defend a right in court. This is what the Civil Court of Cassation ruled with order no. 5844/2025.
