During the conference, Avv. Alessandro del Ninno delivered a presentation entitled “Data Protection Obligations in the Implementation of Digitalisation, Dematerialisation and Digital Preservation Processes”, addressing the main legal and operational aspects arising from the digital transformation of businesses.
In particular, the presentation examined:
the obligations and requirements deriving from the coordination between DPCM, the Italian Digital Administration Code (CAD), the eIDAS Regulation, AGID Guidelines, and data protection legislation;
the application of the principles set out in Article 5 of the GDPR to digitalisation, dematerialisation and digital preservation processes;
the functional relationship between the Data Protection Officer (DPO) and the Digital Preservation Officer;
the security measures required under Article 32 GDPR, with a specific focus on the encryption of special categories of data;
digitalisation, dematerialisation and digital preservation services in light of the principles of privacy by design and privacy by default, as well as the most recent EDPB Guidelines;
the contractual regulation of relationships with service providers, including outsourcing arrangements, processing instructions and data protection roles.
The presentation provided a comprehensive overview of the main regulatory and contractual challenges related to the implementation of digitalisation and digital preservation processes, offering participants practical tools for the correct management of data protection obligation.
