On September 16, 2025, Avv. Alessandro del Ninno held as sole speaker the workshop organized by Paradigma on the EU Regulation 2023/2854 – Data Act.
The event provided an in-depth overview of the upcoming obligations deriving from the regulation, which will apply as of September 12, 2025.
The program addressed key topics such as:
Scope of application of the Data Act and its relationship with existing voluntary data-sharing agreements;
B2C and B2B data sharing, including rights and obligations of users and data holders, and duties of third parties receiving data;
Data availability: conditions, trade secret protection, compensation, dispute resolution bodies, and unfair contractual clauses;
Obligations towards public bodies in cases of “exceptional need” and related safeguards;
Data portability and interoperability: technical requirements, minimum contractual content, non-derogable clauses, and standards for smart contracts;
Enforcement framework, including competent authorities and sanctions.
The workshop highlighted how the Data Act should not be regarded merely as a set of regulatory burdens, but as a framework that will redefine the rules for accessing, using, and sharing data—opening new perspectives in terms of transparency, competitiveness, and user protection.
