Avv. Alessandro del Ninno will speak at the conference devoted to the relationship between the Data Protection Officer and Artificial Intelligence, with a presentation focusing on the DPO’s role in the deployment of AI systems within organisations, in light of European and national primary sources and the most recent guidance issued by regulators.

The presentation examines the coordination between the GDPR, the EU Artificial Intelligence Regulation, the Italian national AI legislation, and the relevant interpretative instruments, including EDPB Opinion 28/2024 and the reports issued in June 2025 by the Support Pool of Experts on security, compliance and data protection in AI systems.

Avv. del Ninno emphasises that the DPO is neither the technical nor the operational owner of AI systems, nor does the DPO replace the controller in organisational decision-making. Rather, the DPO retains the role of providing advice, exercising independent oversight, supporting data protection impact assessments, cooperating with the supervisory authority and safeguarding accountability.

In the context of AI, these functions acquire enhanced relevance. The DPO is called upon to assess legal bases, transparency, data minimisation, security, data protection by design and by default, risk management and the proper conduct of DPIAs in connection with processing operations involving algorithmic or automated systems.

The presentation therefore offers a technical-legal and operational analysis of the DPO as an essential function within AI governance, contributing to the development of organisational models that are trustworthy, properly documented and compliant with European and national data protection law.
