Italian Data Protection Authority favourable opinion on the draft decree containing the Guidelines of the Agency for Digital Italy (AgID) on digital accessibility.

Favourable opinion of the Italian Data Protection Authority on the draft decree of AGID, which defines the Guidelines on the accessibility of public and private services (e.g., passenger transport, internet, payment systems). The goal is to offer services and information that can also be used by people with disabilities, without discrimination.

In prescribing the obligations of the service provider, the scheme takes into account the indications provided by the office of the Italian Data Protection Authority, aimed at ensuring compliance with privacy legislation.

Based on the GDPR's principles of privacy by design and privacy by default, service providers dedicated to people with disabilities will be obliged to take appropriate measures to avoid tracking the tools, solutions and settings of use that help them access digital services. They must also expressly declare that they do not use web tracking techniques from which it is possible to deduce any conditions of disability of the user.

AGID, which is responsible for supervision, will then have to identify and adopt appropriate and specific measures aimed at protecting the data of the data subjects also in the implementation and management of the platform that it will make available for the performance of the activities of competence.

In giving the go-ahead, the Authority reiterated that, based on the principle of accountability, the responsibility of both public and private providers, as data controllers, to comply with the regulations on the protection of personal data remains unaffected.
