Remote Monitoring of Workers’ Activities: Privacy, Labour Protections and Technological Developments

Lecture at the Conference organized by Optime S.p.A. - Rome, 6 November 2025.

Remote Monitoring of Workers’ Activities: Privacy, Labour Protections and Technological Developments

The conference “Remote Monitoring of Workers’ Activities: Privacy, Labour Protections and Technological Developments” offers a structured and comprehensive overview of the intersection between labour law, data protection regulation and emerging monitoring technologies. The programme examines recent case law, the positions of the Italian Data Protection Authority, and the orientations of the National Labour Inspectorate, while providing operational guidance on how to implement compliant corporate policies, manage lawful monitoring in on-site and remote-working contexts, and correctly structure disciplinary proceedings based on digital evidence.

The contribution of Avv. Alessandro Del Ninno serves as the central data-protection pillar of the event. His presentation analyses the relevant regulatory framework encompassing Article 4 of the Workers’ Statute, the GDPR and the Italian Privacy Code, highlighting both the lawful grounds and the limitations applicable to digital monitoring activities. Special attention is devoted to recent decisions of the Italian Data Protection Authority, including Decisions No. 364/2024 and No. 472/2024 on the management of employees’ e-mail and metadata, as well as decisions concerning video surveillance, biometric data and geolocation (e.g., Decisions No. 231/2023, No. 403/2023 and No. 338/2024).

Avv. Del Ninno further explores the impact of Artificial Intelligence on remote monitoring, illustrating how the EU Artificial Intelligence Regulation affects advanced monitoring systems and the governance of algorithmic management, also in light of the EU Directive on platform work. The presentation concludes with a practical section focused on the correct drafting of internal IT-use regulations and employee privacy notices, which are essential tools for ensuring transparency, proportionality and full regulatory compliance.
